If you have foreign financial accounts that together topped $10,000 at any point in a year, U.S. law required an FBAR filing for that year. For over a decade, people who missed that filing but had paid all their taxes had a safe, published way to catch up without penalty. As of July 1, 2026, that path is gone.

What Disappeared on July 1

Since 2014, the IRS's Delinquent FBAR Submission Procedures promised something simple: if you reported all your foreign income and paid your tax, and your missed FBAR was an honest oversight, you could file the late reports and no penalty would apply. On July 1 the IRS removed that page from its website without any announcement. The agency's guidance now says only that a late FBAR “is a violation and may subject you to penalties,” and that you should file as soon as possible.

The Law Did Not Change. Your Options Did.

Penalties are still not automatic, and an honest mistake is still treated differently than hiding money offshore. But the written assurance is gone, which means outcomes now depend on facts, documentation, and presentation.

  • Non-willful violations: up to $16,536 per year (2026 amount), applied per late form rather than per account after the Supreme Court's Bittner decision.
  • Willful violations: the greater of $165,353 or 50% of the account balance, per account, per year.

What Still Works

  • All income reported, tax paid: file the late FBARs with a well-built reasonable cause statement. Done right, penalty-free outcomes remain realistic.
  • Some income went unreported, but the mistake was honest: the Streamlined Filing Compliance Procedures remain open. Taxpayers living abroad pay no offshore penalty; U.S. residents pay 5%.
  • The problem was not an honest mistake: the IRS Voluntary Disclosure Practice exists for exactly that conversation, and it should happen with counsel first.
  • One more thing: FBAR problems rarely travel alone. Foreign accounts often trigger other filings (foreign asset statements, foreign trust and gift forms, foreign company forms), and the right fix addresses all of them at once.

What This Means for You

  • Add up your foreign accounts for each year. Over $10,000 combined at any moment means an FBAR was due.
  • Do not file blind. Which path fits depends on whether income went unreported and whether the failure was truly non-willful. Picking the wrong door is expensive.
  • Do not wait. The IRS closed its main offshore disclosure program in 2018, stripped penalty assurances from a sister program in 2020, and deleted this one in 2026. The programs still standing are discretionary and can change without notice.
